Section 01

• By accessing our website, submitting an enquiry, or booking any D I V Y A M^® service, you agree to be bound by these Terms of Service
• These terms apply to all users, clients, guests, and visitors of our services
• If you do not agree with any part of these terms, you must not use our services
• We reserve the right to update or modify these terms at any time without prior notice
• Continued use of our services after changes constitutes acceptance of the modified terms
• It is your responsibility to review these terms periodically for updates

Section 03

• A non-refundable booking deposit is required to confirm any service
• Booking is confirmed only after written approval and payment of a 25% booking advance of the approved quotation or proposal value, unless the quotation, proposal, invoice or signed agreement states otherwise.
• After booking confirmation, the client must complete payment up to 80% of the approved quotation or proposal value at least 30 days before the event date, unless a different payment schedule is mentioned in writing.
• The remaining 20% must be paid before event setup, dispatch or service commencement, as applicable.
• D I V Y A M® may pause preparation, dispatch, setup or service if payment milestones are not completed on time.
• Payment methods accepted: bank transfer, credit/debit cards, UPI, and demand draft
• All prices are in Indian Rupees (INR) unless specified otherwise
• GST and applicable taxes will be added to all invoices as per government regulations
• All quotations/proposals are valid for 7 calendar days from the date of issue, unless stated otherwise in writing.
• The remaining payment schedule, GST, due dates and any special payment terms will be as stated in the approved quotation, proposal, invoice or signed agreement.
• Any additional services requested after booking will be billed separately
• Late payments may incur interest charges at 2% per month
• Payment schedules will be outlined in the service agreement

Section 04

• Cancellation More Than 90 Days Before Event: Booking advance may remain non-refundable. Amount paid beyond the booking advance may be eligible for partial refund after deducting planning work, vendor commitments, administrative cost, payment gateway charges, and any actual expenses already incurred.
• Cancellation 61–90 Days Before Event: Booking advance may remain non-refundable. Up to 25%–40% of the total estimated service value may be deducted. Balance amount, if any, may be refunded or adjusted as credit at D I V Y A M®'s discretion.
• Cancellation 31–60 Days Before Event: Booking advance may remain non-refundable. Up to 50%–70% of the total estimated service value may be deducted. Refund, if any, will be calculated after actual cost assessment.
• Cancellation 15–30 Days Before Event: Booking advance may remain non-refundable. Up to 75%–90% of the total estimated service value may be deducted. Limited refund may be available only if D I V Y A M® has not incurred equivalent cost or commitments.
• Cancellation Less Than 15 Days Before Event: No refund may be applicable in most cases. Full or near-full charges may apply.
• Cancellation on Event Day or After Execution Begins: No refund will be applicable. The client may remain liable for the full agreed amount and any additional cost incurred.
• Booking deposit is non-refundable under all circumstances
• Refunds, if approved in writing, will be processed within 15 to 30 working days after written refund approval and receipt of verified bank details. Any refund amount will depend on the approved proposal, work already completed, purchases, customisation, vendor commitments, perishable items, taxes, payment gateway charges and the timing of written cancellation.
• D I V Y A M^® reserves the right to cancel services due to unforeseen circumstances with full refund
• Cancellation, postponement, refund, credit adjustment and booking transfer will be handled as per the Cancellation & Refund Policy, approved quotation, payment record, work completed, vendor commitments, production status and signed agreement, if any.
• Force majeure events may result in modified cancellation terms

Section 05

• Provide accurate and complete information about event requirements
• Communicate all food preferences, allergies, and dietary restrictions in writing
• Inform D I V Y A M^® of any changes to event plans, guest count, or venue details promptly
• Ensure timely payment of all invoices as per the agreed schedule
• Provide necessary access to venues and facilities as required for service delivery
• Obtain required permissions, licenses, or approvals for the event
• Treat all D I V Y A M® staff and vendors with respect and professionalism
• Maintain appropriate guest conduct during all events

Section 06

• D I V Y A M^® is built around pure vegetarian celebrations and does not intentionally use non-vegetarian food, meat, fish, egg or egg-based preparations in its pure vegetarian service setup.
• Clients must not use D I V Y A M^® food infrastructure, counters, utensils or service areas for non-vegetarian food, alcohol service or any item conflicting with the agreed pure vegetarian service commitment, unless separately approved in writing outside the pure vegetarian catering scope.
• Jain, Satvik and no onion-no garlic arrangements may be provided when confirmed in writing before menu finalisation.
• D I V Y A M^® will make reasonable efforts to reduce cross-contact risk where special instructions are confirmed in advance, subject to venue conditions and operational feasibility
• All ingredients are sourced from verified vegetarian suppliers
• Separate preparation areas for different dietary requirements can be arranged

Section 07

• All content on the D I V Y A M^® website, including text, images, logos, and designs, is our intellectual property
• Unauthorized use, reproduction, or distribution of our content is prohibited
• Event photos and videos taken by D I V Y A M^® remain our property unless otherwise agreed
• Clients grant permission to use event media for promotional purposes D I V Y A M^® may photograph or record decor, food, setup, service areas and event work for internal documentation, quality review and portfolio purposes only where permitted by the client and venue rules.
• Public promotional use of identifiable client, family, guest, venue or event media will require written consent or agreed media terms. Clients may also communicate privacy restrictions in writing before the event.
• Proposals, moodboards, and planning documents are for client use only and cannot be shared with competitors
• The D I V Y A M^® name, logo, and branding cannot be used without written permission

Section 08

• D I V Y A M^® is not liable for delays or issues caused by third-party vendors beyond our reasonable control
• Maximum liability is limited to the total amount paid by the client for the specific service
• Clients must inform D I V Y A M^® in writing about all allergies, food sensitivities, medical sensitivities and dietary restrictions before menu finalisation, including the affected guest count, severity, dishes to avoid and any separate-serving requirements.
• D I V Y A M^® will make reasonable efforts to follow confirmed written dietary and allergen instructions. However, allergen risk cannot be completely eliminated in large event catering, buffet service, live counters, guest self-service or venue-based environments.
• D I V Y A M^® is not responsible for allergic reactions, food sensitivities or health issues arising from incomplete, incorrect, delayed or undisclosed allergy/dietary information, guest handling, outside food, venue-provided food or beverages, third-party vendors, unsafe venue conditions, poor water/electricity arrangements, weather, leftover consumption after handover or circumstances outside D I V Y A M^® direct control.
• Consequential, incidental, or indirect damages are not covered under this agreement
• Client assumes responsibility for guest behavior and any resulting damages
• Venue-provided amenities, security, or facilities are not under our liability
• Force majeure events including natural disasters, pandemics, or government restrictions limit our liability

Section 09

• Client agrees to indemnify D I V Y A M^® against claims arising from guest conduct at events
• Client is responsible for damages caused by guests or family members to venue property
• D I V Y A M^® is indemnified against claims related to client-provided inaccurate information
• Legal costs incurred due to client breach of terms will be borne by the client
• Third-party claims arising from event operations where client gave specific instructions are client's responsibility

Section 10

• D I V Y A M^® is not liable for delays or inability to perform services due to events beyond reasonable control
• Force majeure includes natural disasters, pandemics, government restrictions, riots, wars, or strikes
• Both parties may reschedule the event to a mutually agreed date without penalty
• If rescheduling is not possible, client may receive credit for future services
• Refunds for force majeure cancellations will be at D I V Y A M^®'s discretion based on incurred costs
• We will communicate promptly about any force majeure affecting your event

Section 11

• These terms are governed by the laws of India
• Courts in Prayagraj, Uttar Pradesh have exclusive jurisdiction over any disputes
• Any legal proceedings must be filed within one year of the cause of action
• The Indian Contract Act, 1872 applies to all agreements under these terms
• Consumer protection laws in India may provide additional rights to clients
• GST and tax laws of India apply to all financial transactions

Section 12

• Both parties agree to first attempt informal resolution through good-faith negotiations
• If informal resolution fails, disputes will be referred to binding arbitration in Prayagraj
• Arbitration will be conducted by a single arbitrator mutually agreed upon
• Arbitration proceedings are confidential unless required by law
• Each party bears its own costs for arbitration unless the arbitrator decides otherwise
• Arbitration award is final and binding on both parties

Section 13

• D I V Y A M^® reserves the right to update these Terms of Service at any time
• Changes become effective immediately upon posting on our website
• Material changes will be communicated via email to active clients
• Continued engagement with D I V Y A M^® after changes constitutes acceptance
• Clients are encouraged to review terms before each new booking
• Historical versions of terms are available upon written request
